Terms And Conditions

These Terms and Conditions ("Terms") govern your access to and use of the GrabZad website, mobile experience, and grocery delivery services (collectively, the "Services") operated by GrabZad ("GrabZad," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Accounts

  • You must be at least 18 years old to place an order.

  • You are responsible for the accuracy of your account information and for maintaining the confidentiality of your login credentials. You are responsible for all activity under your account.

  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

2. Service Area

The Services are currently available only for delivery addresses within the State of New Jersey. We may expand, restrict, or modify the service area at any time.

3. Orders, Pricing, and Payment

  • All orders are subject to acceptance and product availability. We may refuse or cancel any order, including for suspected fraud or pricing errors.

  • Prices, fees, and promotions are displayed at checkout and may change without notice. In case of an obvious pricing error, we may cancel the affected order and refund you in full.

  • Payment is charged at or after checkout using the payment method you provide. You represent that you are authorized to use that payment method.

  • Applicable sales tax is calculated and added in accordance with New Jersey law.

4. Substitutions and Availability

Grocery inventory changes frequently. If an item is unavailable, we may substitute a comparable item consistent with the preferences you set at checkout, or omit and refund the item. Substitution and refund handling is described in our Refund Policy.

5. Delivery

Delivery terms, including delivery windows, fees, unattended delivery, and failed deliveries, are set out in our Delivery Policy, which is incorporated into these Terms.

6. Refunds and Cancellations

Refunds, replacements, and cancellations are governed by our Refund Policy, which is incorporated into these Terms.

7. Product Information

  • We strive for accuracy in product descriptions, images, pricing, and labeling (including Halal designations provided by manufacturers), but we do not warrant that all content is error-free.

  • Always review the physical product label for the most accurate ingredient, allergen, and certification information before use. If you have allergies or dietary requirements, rely on the manufacturer’s label, not our listings.

8. Promotions, Coupons, and Discounts

  • We may offer promotions, coupons, referral rewards, and discounts at our discretion, and may modify or end them at any time. Unless stated otherwise, one coupon may be used per order, and promotions cannot be transferred, sold, applied to past orders, or combined with other offers.

  • Abuse of promotions — including creating multiple accounts to reuse limited offers — may result in order cancellation, forfeiture of credits, and account suspension.

9. Communications; Text Messages

  • We will send transactional communications (order confirmations, invoices, delivery updates, account notices) electronically to the email address and/or phone number on your account. You agree that electronic communications satisfy any requirement that notices be in writing.

  • By providing your phone number, you consent to receive order-related text messages. If you opt in to marketing texts, message and data rates may apply. Reply STOP at any time to unsubscribe from texts; use the unsubscribe link to opt out of marketing emails. Opting out of marketing does not affect transactional messages about your orders.

10. Product Recalls

If a product is recalled by the manufacturer or a government agency, we will notify affected customers and provide refunds as described in our Refund Policy.

11. Acceptable Use

You agree not to misuse the Services, including by: submitting false orders or claims; interfering with the operation or security of the Services; scraping or copying content without permission; or violating any applicable law.

12. Intellectual Property

The GrabZad name, logo, website content, and design are owned by GrabZad or its licensors and are protected by intellectual property laws. You may not use them without our prior written consent.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GRABZAD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold GrabZad harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Services.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in New Jersey, and you consent to their jurisdiction. Before filing a claim, you agree to first contact us to attempt an informal resolution.

17. Severability; Assignment; Survival

  • If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

  • We may assign these Terms to an affiliate or to an entity that acquires all or substantially all of our business or assets. You may not assign these Terms without our written consent.

  • Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) survive termination of your account or these Terms.

18. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a new effective date, and continued use of the Services after posting constitutes acceptance.
